CAB Overview

CAB Delivers a Rocket-Docket in FY24 and Is On Pace to Continue Prompt Dispositions in FY25

The DC Contract Appeals Board, like other courts that administer civil justice, works rigorously to keep litigation delays and costs to an absolute minimum. Delays not only increase the risk that witnesses and evidence may be unavailable at trial, delays also increase opportunities for litigation costs to escalate unreasonably.  In FY24, CAB closed 100% of protest cases within the 60-business day statutory deadline (D.C. Code § 2-360.08(d)), averaging only 33 business days to close protests. In FY24, CAB closed 100% of appeals cases timely, averaging only 1.3 years to close appeals.  Moreover, 56.6% of all FY24 closed cases were resolved through settlement prior to trial or written disposition.

In FY25 (to date), CAB has closed 100% of protest cases within the 60 business-day statutory deadline, averaging only 41 business days to close protests. In FY25 (to date), CAB has closed 100% of appeals cases timely, averaging less than one-year to close appeals. Moreover, 77% of all FY25 (to date) closed cases were resolved through settlement prior to trial or written disposition. Because of CAB’s excellent closure rates, the Board does not have a case backlog on its appeal or protest dockets.     

In FY25 (to date), the DC Courts Affirmed Three CAB Protest Decisions. CAB Has Now Been Affirmed in 10 Consecutive Decisions

On October 31, 2024 (CAB No. P-1188) and December 20, 2024 (CAB Nos. P-1160 and P-1187), the DC Superior Court affirmed three recent CAB protest cases. With these three most recent decisions, the DC Courts have now affirmed the Board in 10 consecutive cases dating back to 2017.1 Board Judges Loud, Parchment, and Majett, and the CAB team, are commended for their continuing tradition of excellence.    

In FY25, Please Complete CAB’s Case Search Survey 

In FY23, the transparency of Board litigation records took a gigantic leap forward when 40,831 newly digitized and searchable pdf legacy records were uploaded to the Board’s website for public viewing cab.dc.gov. The newly uploaded records added approximately 1.2 million pages of case materials to the Board’s website. These records can be searched using keyword, date, case name or other search protocols. In addition, all records in newly filed FY25 cases continue to be uploaded to the Board’s website within three business days of filing (excluding confidential records sealed pursuant to Board Orders). Please share your experience searching for CAB case records by completing the survey below. CAB case searches are conducted in a cloud environment, which allows for enhanced security protection and seamless integration with emerging technologies.

Courtroom Calendar

The DC Contract Appeals Board online calendar was launched in March 2012 in partnership with the DC OCTO and offers a comprehensive online calendar of upcoming Board trials. The calendar is updated regularly and displays currently scheduled trials. The Board will conduct in-person and hybrid trials (as appropriate) in FY25. All Board trials are open to the public, except those that are subject to a protective order (as noted on the Board’s website).
